Defense Attorney Discovery Access
The Box Elder County Attorney's Office strives to strictly adhere to the discovery requirements in Rule 16 of the Utah Rules of Criminal Procedure and to abide by the standard of disclosure of exculpatory evidence established in Brady v. Maryland, 373 U.S. 83 (1963), and its progeny.
How To Obtain Discovery
To ensure prompt delivery of all available discovery, you must:
1. File a discovery request AND an entry of appearance
2. Pay the required discovery fee

- Consistent with State v. Kearns, 2006 UT App 458, defendants are not entitled to free copies of the discovery
- Pursuant to Box Elder County Resolution 09-04 and section 76-5-302 of the Utah Code, the County Attorney's Office charges the following fees for discovery items:

Electronic Delivery $5.00
25 or less pages printed $10.00
More than 25 pages printed $25.00+
Citation (with notes) Free
Media
CD or DVD $5.00/disc
USB flash drive $10.00/drive
3. Discovery access link will be emailed to you at the email provided on your receipt. You will have 21 days to access/download files from the link provided.
Subsequent Discovery
In the event that additional discovery becomes available after you are provided the initial discovery, we will immediately make you aware of its existence. Please be aware that there may be an additional charge for subsequent discovery.
