Conditional Use Permits
Overview
A conditional use is a land use that, because of its unique characteristics or potential impact on Box Elder County, surrounding neighbors, or adjacent land uses, may not be compatible in some areas or may be compatible only if certain conditions are required that mitigate or eliminate the detrimental impacts. A conditional use permit (CUP) is the permission granted by the County to use or access properties under special circumstances and with specific requirements and conditions attached.
Process
Upon receipt of the required documentation and any associated fees, the Planning Department will review your application for adherence to the Box Elder County Land Use Management and Development Code. During the review process, your application will be placed on the Planning Commission agenda for their review and final decision. The Planning Commission will approve, approve with conditions, or deny the application if the standards of the applicable ordinances cannot be met and detrimental impacts cannot be mitigated.

Additional Information
- A public hearing is required with the Planning Commission.
- Any commercial or industrial conditional use permit also requires a site plan as part of the application.
